TERMS & CONDITIONS

Matcam Holdings Pty Ltd reserves the right to modify these Conditions, and any such variations will be published on the Matcam website. By placing orders for goods or services after the publication of revised Conditions, the purchaser acknowledges and accepts the modified terms.

No changes or cancellations of these Conditions shall be effective unless agreed upon in writing by a responsible officer of Matcam Holdings Pty Ltd. Agents or representatives lack the authority to waive or alter these Conditions.

Orders for goods or services can be placed by the purchaser or their representatives through telephone, email, in writing, or by facsimile transmission.

Precedence

In the event of a conflict between these Conditions and any terms included in, or implied by, documents forming part of any enquiry, specification, order, or contract, these Conditions shall prevail unless expressly varied by Matcam Holdings Pty Ltd in writing. If any Condition contradicts or is excluded by law, the Conditions shall be adjusted to the extent necessary to exclude the affected portion.

Acceptance

A quotation is not an offer or obligation to sell, and Matcam Holdings Pty Ltd reserves the right to decline any order (wholly or partially) at any time before delivery. In such cases,  Matcam Holdings Pty Ltd is not obligated in respect of the declined order.

Prices

Prices are subject to change without notice, and orders are accepted based on the prices in effect at the date of dispatch. Every effort will be made to provide 30 days’ notice of any price increase.

Terms of Payment

The purchaser agrees to comply with the Conditions, and payment for goods and services must be made to Matcam Holdings Pty Ltd before dispatch, unless otherwise agreed in writing.

Cancellation

Matcam Holdings Pty Ltd may terminate any order if the purchaser becomes insolvent, faces execution against goods, enters administration or liquidation (voluntarily or involuntarily), or if there are changes in creditworthiness. In such cases, Matcam Holdings Pty Ltd is not liable for any loss or damage.

Variation

Any variation or cancellation of an order is subject to Matcam Holdings Pty Ltd’s acceptance. If accepted, the purchaser indemnifies Matcam Holdings Pty Ltd against any resulting loss or damage.

Warranties Limited

Matcam Holdings Pty Ltd warrants goods to be of good and merchantable quality, limited to repair or replacement under the manufacturer’s warranty. Matcam Holdings Pty Ltd disclaims any warranties beyond the manufacturer’s, and shall not be liable for any direct or indirect loss or damages.

Inspection

The purchaser has seven (7) days from the date of delivery to provide written notice of any claim for non-compliance. Failure to do so within this period deems Matcam Holdings Pty Ltd to have fulfilled the order.

Packing, Damage, or Loss in Transit

Matcam Holdings Pty Ltd takes care in packing, it is not liable for loss or damage in transit. Claims regarding loss or damage are matters between the purchaser and the transportation provider. The purchaser must inspect and report any shortage within forty-eight (48) hours of delivery.

Purchaser’s Specifications

Matcam Holdings Pty Ltd is not obligated to comply with specifications unless provided and signed by Matcam Holdings Pty Ltd before delivery. No warranty is given for the goods’ fitness for a specific purpose, and the purchaser agrees not to rely on Matcam Holdings Pty Ltd ‘s judgment.

Risk

All goods sold are at the purchaser’s risk from dispatch, and the purchaser is responsible for insuring goods in transit.
